Objectives

Individual Learning Session: Mental Capacity Act 2005 - An Introduction

At the end of this session you will:

  • have an insight, understanding and knowledge of the background and context of the Mental Capacity Act (2005) and its five principles
  • understand what is regarded as mental capacity and how to assess those who may lack the capacity to make a decision
  • understand what is meant by best interests decisions and the steps which need to be followed to ensure that these are made in accordance with the law
  • know the way in which DoLS should be interpreted in the light of the Supreme Court's decisions in 2014
  • have evidence of how they would implement the Act and the supporting DoLS regulations in relation to casework
